("V4 FITNESS"), and the websites of the below listed companies, divisions or service groups, or any page thereof, through any direct or indirect means (individually or collectively, "Websites" or "Website"), or by using the goods, facilities or services offered in or through the Websites through alternative methods (including, for example, telephone, mail, or email), you accept and agree to be bound by these Terms of Use (the terms "Website" and "Websites" include use through these alternative methods). If you disagree with any of the V4 FITNESS TERMS OF USE, you will not register for an account.

By registering, logging on, and using the V4 FITNESS online coaching community, you hereby agree to accept these terms and conditions and further agree to indemnify and hold harmless BALANCED STRENGTH, INC. ("BSI"), its officers, directors, fitness team members, shareholders and employees from any accidents, injuries, or direct or indirect damages of any kind which you may experience from your fitness activities or the use of the V4 FITNESS website.

By signing up for the V4 FITNESS service ("Service"), you are agreeing to be bound by the following terms and conditions ("Terms of Service"). Any new features or tools which are added to the current Service shall be also subject to the Terms of Service. You can review the most current version of the Terms of Service at any time at: http://balancedstrength.com/v4fitness/register/. V4 FITNESS Corporation reserves the right to update and change the Terms of Service by posting updates and changes to the V4 FITNESS website. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you.

Terms of Service
V4 FITNESS has been developed to help our users track their health and fitness progress, reach their health and fitness goals, build healthier habits, and lead a healthy lifestyle. The authors of this web site are providing information for educational purposes only. V4 FITNESS shall not be used to replace the services of any health, fitness, physical rehabilitation specialists, or other professionals in those and similar fields. The information provided within this website and from our services is not intended to be a diagnosis or prescription. Before beginning any diet or fitness program please consult a physician. V4 FITNESS always advises you to discontinue any exercise or activity that causes you pain or severe discomfort and consult a medical expert. The authors of this web site, and all its content, do not guarantee any exercise, health improvement, clinical or otherwise, weight loss or fitness results or improvements to the users of V4 FITNESS.

Terms of Your Account
1. You must be 18 years or older to use this Service.
2. You must provide a valid email address and any other information needed in order to complete the signup process.
3. You are responsible for keeping your password secure. V4 FITNESS, BSI, its officers, directors, fitness team members, shareholders and employees are not be liable for any loss or damage from your failure to maintain the security of your account and password.
4. You may not use the service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws) as well as the laws of the United States.
5. You are responsible for all activity and content (data, graphics, photos, links) that is uploaded or created under your V4 FITNESS account.
6. A breach or violation of any of the Account Terms as determined in the sole discretion of BALANCED STRENGTH, INC. will result in an immediate termination of your services.

General Conditions
1. We reserve the right to modify or terminate the Service for any reason, without notice at any time.
2. We reserve the right to refuse service to anyone for any reason at any time.
3. Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis without any warranty or condition, express, implied or statutory.
4. V4 FITNESS does not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
5. We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.
6. You expressly understand and agree that V4 FITNESS, BSI, its officers, directors, fitness team members, shareholders and employees are not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service.
7. Technical support is provided to all account holders and is only available via email.
8. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by V4 FITNESS Corporation.
9. Verbal or written abuse of any kind (including threats of abuse or retribution) to any V4 FITNESS customer, V4 FITNESS employee, member, or officer will result in immediate account termination.
10. The failure of V4 FITNESS to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and V4 FITNESS and BALANCED STRENGTH, INC. and governs your use of the Service, superseding any prior agreements between you and V4 FITNESS (including, but not limited to, any prior versions of the Terms of Service).

Use of Content
Use of V4 FITNESS content is for educational, informational and non-commercial or personal use only. You may not modify any content, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, post on any network, broadcast in any media or sell any information, software, products or services obtained from the Services unless expressly permitted by BALANCED STRENGTH, INC. Elements of BSI and V4 FITNESS websites are protected by trade dress, trademark, unfair competition, and other laws and may not be copied or imitated in whole or in part. Content other than that belonging to V4 FITNESS is licensed or otherwise published by V4 FITNESS with the permission of the owner of the material. All rights in such materials are reserved to the respective owners.

Release of Indemnity
By logging on and using V4 FITNESS, you agree that you voluntarily participate in any of the activities suggested by BSI's Fitness Team, understand that you are responsible for monitoring your own condition throughout any exercises or activities, and should any unusual symptoms occur, you are advised to cease participation and inform a physician.  

As agreed upon in these TERMS, you agree to assume any risk of such activities or using the services of V4 FITNESS and BSI, and further agree to hold harmless the organization, its officers, directors, fitness team members, shareholders and employees from any and all claims suits, losses, or related causes of action for damages, including but not limited to, such claims that may result from injury or death, accidental or otherwise, accidents, injuries, or direct or indirect damages of any kind which you may experience from your fitness activities or the use of the V4 FITNESS.

You agree to irrevocably and unconditionally release, acquit and forever discharge BSI, V4 FITNESS, affiliated companies, and agents from any and all complaints, claims, damages, suits, actions, losses, rights and liabilities of any nature arising out of my participation and/or involvement in V4 FITNESS.

You understand and agree that participation and/or involvement is completely voluntary, and further agree that any and all damages, costs, losses and expenses incurred by me as a result of your participation and/or involvement in V4 FITNESS shall be borne by yourself.
